(September 9, 2010) The Los Angeles County District Attorney's Office declined today to pursue a criminal case against ESPN sports personality Jay Mariotti, who was arrested last month on suspicion of domestic assault for allegedly roughing up his girlfriend.

The matter was referred to the Los Angeles City Attorney's Office, according to Shiara Davila-Morales of the District Attorney's Office.

A spokesman for the City Attorney's Office said the potential case had not been turned over yet.

Mariotti, 51, was arrested at an apartment near Venice about 4:30 a.m. Aug. 21 and was released later the same morning after $50,000 bail was posted.

Mariotti got into an argument with his girlfriend at a club in Santa Monica, where he believed she had been flirting with another man, police told the Los Angeles Times.

Witnesses saw the two exchange "harsh words' before getting into a car to leave, and the fight allegedly continued at the couple's apartment, The Times reported.

Mariotti is a panelist on the ESPN talk show "Around the Horn.'

He formerly wrote sports columns for the Denver Post and Chicago Sun-Times and currently writes a column for the website Fanhouse.com.
