Ex-sportscaster Dubay sentenced
(July 29, 2009) Former KFAN Radio sports talk personality Jeff Dubay was sentenced Tuesday to 180 days in the Ramsey County workhouse for failing to complete substance-abuse programs and repeatedly testing positive for cocaine.

District Judge Joanne Smith had Dubay taken into custody immediately, rejecting his lawyer's request that Dubay start his sentence at a later date.

"I think at this point, it's important that Mr. Dubay understand the consequences of his actions," said Smith, who could have sent him to prison for a year and a day.

Dubay, 41, of Plymouth, was fired as a morning-show host after he was charged last October with fifth-degree drug possession. He was placed in a yearlong diversion program, which could have resulted in the charge being dismissed. It required him to perform 100 hours of community service and remain law-abiding.

He flunked out of that program but was accepted into Substance Abuse Court in March, according to Ramsey County District Court records. As part of the court program, he pleaded guilty to the felony drug possession charge.

Dubay tested positive for cocaine 12 times, most recently on June 6. He also failed to report for 11 urine tests since January. Those violations disqualified him from the Substance Abuse Court. Dubay was arrested on June 10 and released on bail two days later.

Dubay had been co-host of the midday show with Paul Allen for 10 years.

As deputies escorted him from the courtroom and into a holding cell to be transported to the workhouse, Dubay looked shocked.

Dubay's attorney, Mark Kelly, told the judge that his client has been abusing cocaine for 18 months. "It's difficult to comprehend how much this has cost him," Kelly said of Dubay.

He said Dubay would be helped most by relocating to an area disconnected from his source for drugs.
